Terms of Use

  • Severability If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Entire Agreement The Terms of Use constitute the sole and entire agreement between you and BatMaster regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
  • Assignment These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by BatMaster without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
  • Notices Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, will be in writing and given by BatMaster (i) via email (in each case to the address that you provide) or (ii) by posting to the Service. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
  • Force Majeure BatMaster shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond BatMaster's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
  • Export Control You agree to comply with all Indian and foreign export laws and regulations to ensure that neither the Service nor any technical data related thereto nor any direct product thereof is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations. By using the Service, you represent and warrant that: (i) you are not located in a country that is subject to an Indian government embargo, or that has been designated by the Indian government as a "terrorist supporting" country; and (ii) you are not listed on any Indian government list of prohibited or restricted parties.
  • Survival All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
